Recruitment fees above the permitted limit are recoverable from a licensed agency. The difficulty is almost never the law. It is the evidence.
Keep everything
Receipts, bank transfers, money transfer slips and messages arranging payment all help establish what was actually paid, particularly where no formal receipt was given.
Keep both contracts
Where the job abroad differed from what was agreed, the contract signed in Nepal and whatever was signed on arrival are the claim. The difference between them is the point.
Where the claim goes
Claims against licensed agencies are pursued through the Department of Foreign Employment and the Foreign Employment Tribunal. Time limits apply, so advice early is worth more than advice later.
If a worker died or was injured abroad
Compensation and insurance claims may be available through the Foreign Employment Board and the employer. These are separate from any claim against the agency and can run alongside it.
